Seattle Deactivation Policy
Effective: January 1, 2025
Purpose: The purpose of this policy (“Deactivation Policy”) is to outline the circumstances under which the Wonolo accounts of covered Wonoloers in the City of Seattle (“Seattle”) may be deactivated, pursuant to the App-Based Worker Deactivation Rights Ordinance (the “Deactivation Ordinance”) – SMC 8.40.
Terms used and Wonolo policies listed in this Deactivation Policy and not otherwise defined shall have the same meanings as given to such terms in the Wonolo Terms of Use found at https://info.wonolo.com/terms/ (“ToU”).
Scope: This policy applies to all covered app-based workers (as defined by SMC 8.40), whose Wonolo accounts are deactivated due to an incident from or related to the performance of Services within the City of Seattle or who, over the past 180 days, have performed at least 25% of their Services within the City of Seattle.
Grounds for Deactivation: The circumstances that may warrant account deactivation are outlined below, and are reasonably related to Wonolo’s safe and efficient operations. Unless otherwise specified, deactivations may result in permanent loss of access to the Wonolo Application.
Wonolo may deactivate a Wonoloer’s Wonolo account if the Wonoloer is suspected of materially breaching, or is credibly alleged to have materially breached, Wonolo’s ToU (which is incorporated as part of this policy), including without limitation, the non-egregious breach of: Wonolo’s Acceptable Use Policy and Wonolo’s User Equality Policy.
In addition, Wonolo may immediately and without prior notice deactivate the Wonolo account of a Wonoloer if such action is required to comply with any applicable court order or local, state, or federal laws or regulations, or where a Wonoloer has engaged in egregious misconduct.
Egregious misconduct means an action or conduct by a Wonoloer that: (1) endangers the physical safety of a customer, or a third person, Wonolo, or an animal; or (2) intentionally causes economic harm to a customer, a third person, or Wonolo; or (3) is threatening, harassing, or abusive to a customer, a third party, or Wonolo. Egregious misconduct includes but is not limited to: assault, sexual assault, sexual harassment, hate crimes, racial slurs, kidnapping, unlawful possession of a firearm, solicitation of any sexual act, registration as a sex offender, stalking, theft, fraud, robbery, burglary, money laundering, driving related crimes pursuant to Revised Code of Washington (RCW) 46.61.500 through 46.61.540 as amended, failing to maintain a valid license or certification needed to perform the Services, and other conduct that would constitute a Class A felony offense under Title 9 or 9A RCW as amended. The terms in this paragraph shall be defined in the following order of precedence: (1) OLS administrative rules adopted under this Deactivation Ordinance; and (2) Washington state law.
A temporary suspension lasting less than 48 hours when the Wonolo Application is unavailable to a Wonoloer due to reasons unrelated to the action or behavior of the Wonoloer and that is clearly communicated to the Wonoloer at the time of the temporary suspension is not a deactivation. Some examples include:
- Technology, software, or network outages
- Account access, security, or safety issues
- Routine maintenance
- Inclement weather
From time to time your account may require your attention or other action by you to resolve access or security issues. When this happens, it is not a deactivation.
Investigation: In all cases of an account deactivation, a fair and objective investigation will be conducted. The investigation shall be sufficiently thorough to justify the deactivation and demonstrate an unbiased and neutral view of facts.
If the Wonoloer fails to participate in the investigation or cooperate with Wonolo in providing additional information, Wonolo will proceed with the investigation based on the best available sources of information.
Notice of Deactivation: For a deactivation not involving egregious misconduct, Wonolo will provide a notice of deactivation 14 days in advance of the deactivation and upon the effective date of deactivation. For a deactivation involving egregious misconduct, Wonolo will provide a notice of deactivation no later than the effective date of the deactivation.
Deactivation Challenge Procedure: Wonoloers have the right to challenge an account deactivation by submitting an appeal through the Appeals Form within 90 days of the date of deactivation.
Wonoloers can locate their prior completed jobs in the Wonolo Application. Challenges to a deactivation must be submitted via the Appeals Form.
Wonolo will review all additional information provided by the Wonoloer and any other parties who witnessed the incident and will respond to any account deactivation challenges within fourteen (14) days of receiving said challenge.
Wonolo’s response to a challenge to a deactivation will include a statement certified by an individual at Wonolo with authority to deactivate the account of the Wonoloer. The statement will include one of the following:
- Evidentiary substantiation of the deactivation, and responses to questions or claims made by the Wonoloer in challenging the deactivation;
- Any extraordinary circumstances that necessitate a delayed response, along with an anticipated date for a response to either substantiate the deactivation or reinstate the Wonoloer; or
- A determination that the Wonoloer did not violate this Deactivation Policy and as a result, the Wonoloer’s Wonolo account will be reinstated.
