Wonolo’s Survey Giveaway Official Rules

1. Eligibility

Not all Wonolo surveys are eligible for a survey giveaway (“Survey Giveaway”). To participate in a Survey Giveaway, you must 1) receive a direct communication from Wonolo, including email and SMS, containing a link to the eligible survey (the “Eligible Survey”) (the “Eligible Survey Communication”), 2) complete all required questions in the Eligible Survey, and 3) provide your name and email address at the end of the Eligible Survey. In addition to the above requirements, you must be a user of the Wonolo service – i.e., you must have entered into an agreement with Wonolo such as the terms of use (https://info.wonolo.com/terms) or Wonolo Customer agreement (https://info.wonolo.com/customer-agreement) that allows you to post or accept jobs on the Wonolo platform.

2. Agreement to Terms

By participating, you agree to these official rules as well as, Wonolo’s Standard Terms and Conditions for Incentives (the “Standard Terms”). Further, you agree the Survey Giveaway is subject to any further specifications set forth in the Eligible Survey or the Eligible Survey Communication (collectively, the “Rules”). In the event of any inconsistency between the provisions of the Standard Terms and the provisions of the Rules, the Rules will prevail. You represent and warrant that you meet all the eligibility requirements set forth in the Rules. In addition, you agree to accept the decisions of Wonolo, as final and binding as it relates to the Survey Giveaway, including the Rules, and your eligibility. For individuals who use the Wonolo mobile application (the “Wonolo App”), these Rules are in addition to but do not supersede the Independent Contractor Services Agreement(s) that you have agreed to or agree to when you use the Wonolo App (the “Services Agreement”), the current version of which is available at this link: https://info.wonolo.com/terms, as well as any documents incorporated by the Services Agreement. In the event of any inconsistency between the Rules and the specifications in the Eligible Survey or the Eligible Survey Communication, the latter shall prevail.

3. Survey Period

A Survey Giveaway begins on the day an Eligible Survey Communication is sent to you by Wonolo. Unless otherwise specified in the Eligible Survey or the Eligible Survey Communication, you must complete the Eligible Survey within the period provided in the Eligible Survey Communication (the “Survey Period”).

4. How to Enter

The requirements for entry are specified in the Eligible Survey Communication. In order to win a prize, your entry must fulfill all requirements for the specific Survey Giveaway. Entries that Wonolo finds in its sole discretion to be incomplete or to not adhere to the Rules may be disqualified. Unless otherwise specified in the Eligible Survey Communication or in the Eligible Survey, you may enter each Survey Giveaway only once.

5. Prizes

The prizes for each Survey Giveaway are as specified in the Eligible Survey Communication. Wonolo may, at its sole discretion, decide the method in which the prizes are disbursed, such as via an incentive payment or in the form of gift cards from common retailers and/or service providers, including but not limited to Amazon, Walmart, Visa, Uber, Lyft, etc.

If you are a Wonoloer, Wonolo may disburse the prizes in the form of incentive payment. The incentive payment will be disbursed to the payment account that you have registered in the Wonolo App. The incentive payment will generally reach your bank account in 3 – 5 business days after it’s disbursed.

If the prizes are disbursed in the form of gift cards, they will be delivered electronically to the email address you provided at the end of the Eligible Survey.

The quantity of prizes will be listed in the Eligible Survey Communication for each Eligible Survey. Sample configurations include:

• 1 x $20 Amazon gift card
• 5 x $5 Amazon gift cards
• 10 x $5 incentive payments
• 1 x $50 Lyft gift card; 3 x $20 Lyft gift cards; 10 x $10 Lyft gift cards

Except to the extent prohibited by applicable law or regulation, all prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted where the prizes are not in cash.

6. Odds

The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification

The winners of the Survey Giveaway will be selected in a random drawing under the supervision of Wonolo. The winner selection should occur within three (3) business days following the end of the Survey Period. Each winner will be notified via email to the email address they provided within the Eligible Survey within ten (10) business days following the winner selection. Wonolo shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, or fails to claim the prize within fifteen (15) days from the date the award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected. The receipt by the winner of the prize offered in the Survey Giveaway is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE RULES BY A WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SURVEY GIVEAWAY AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Terms

Wonolo reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Survey Giveaway (in its sole discretion) for any purpose except to the extent prohibited under applicable laws or regulations. These reasons might include any of the following: a virus, bug, non-authorized human intervention, fraud or other causes beyond Wonolo’s reasonables control that corrupt or affect the administration, security, fairness or proper conduct of the Survey Giveaway (the “Corruption”). In such cases and unless prohibited by applicable law or regulations, Wonolo may select the winners from all eligible entries received prior to and/or after (if appropriate) any action taken by Wonolo in an attempt to resolve the Corruption. Wonolo reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Survey Giveaway or website or violates these Rules or the Services Agreement or otherwise supports or contributes to any Corruption.

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Survey Giveaway may be a violation of criminal and civil laws and should such an attempt be made, Wonolo reserves the right to seek damages from any such person to the fullest extent permitted by law.

9. Limitation of Liability

By entering you agree to release and hold harmless Wonolo Inc. (“Wonolo”) and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Survey Giveaway and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Survey Giveaway; or (v) electronic or human error which may occur in the administration of the Survey Giveaway or the processing of entries.

10. Final and Binding Decision

Wonolo has the right, in its sole discretion, to maintain the integrity of any Incentive Program, to void entries for any reason, including, but not limited to cheating, deception, fraudulent conduct or use of fraudulent methods or other actions, including attempting to circumvent the Terms. In case of any disputes, our decision shall be final and binding upon the parties.

11. Governing Law and Jurisdiction

THIS SURVEY GIVEAWAY IS GOVERNED BY THE LAWS OF U.S.A AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in a Survey Giveaway, you agree that any and all disputes which cannot be resolved between the parties arising out of a Survey Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering a Survey Giveaway), and you further waives all rights to have damages multiplied or increased. This provision does not supersede, modify, limit, or otherwise abrogate any agreement you may have to arbitrate disputes with Wonolo as set forth in the Services Agreement or otherwise.

12. Privacy Policy

13. Winners List

To obtain a copy of the winner’s name for a specific Survey Giveaway or a copy of these Rules, mail your request along with a stamped, self-addressed envelope to: Wonolo Inc. Attn: Survey Giveaway, 9450 SW Gemini Dr. PMB 96809, Beaverton, OR 97008-7105. Requests must be received no later than six (6) months after the termination of the applicable Survey Giveaway Period.
