Wonolo’s Sweepstakes Official Rules

1. Eligibility

The sweepstakes (“Sweepstakes”) is open only to individuals who are 18 as of the date of entry. This is only open to legal residents of the U.S.A  and is void where prohibited by law. Employees of Wonolo Inc. (“Wonolo” or the “Sponsor”), their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited. Wonolo may provide other requirements for eligibility as described in any applicable promotional campaign material (the “Promotional Ad”).

2. Agreement to Terms

By participating, you agree to be fully unconditionally bound by these sweepstakes official rules (“Rules”) as well as Wonolo’s Standard Terms and Conditions for Incentives (the “Standard Terms”) to the extent not inconsistent with these Rules. Further, you represent and warrant that you meet the eligibility requirements set forth herein. In the event of any inconsistency between the provisions of the Standard Terms and the provisions of the Rules, the Rules will prevail.

For individuals who use the Wonolo App (as defined below), these Rules are incorporated into and considered a part of the Independent Contractor Services Agreement that you agree to when you use the Wonolo App and any modifications thereof (the “Services Agreement”), available here or at this link: https://info.wonolo.com/terms as well as any documents incorporated by the Services Agreement.

3. Sweepstakes Period

Sweepstakes beginning and end dates will be identified in the applicable Promotional Ad (the “Sweepstakes Period”). All entries must be received before the end of the Sweepstakes Period provided in the Promotional Ad.

4. How to Enter

To enter the Sweepstakes, you must do one of the following:

A. Via the Wonolo App: olo App”) to find and accept posted jobs, the requirements for entry are as specified in the Promotional Ad. The entry must fulfill all Sweepstakes requirements, as specified, to be eligible to win a prize. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Wonolo. Unless otherwise specified in the Promotional Ad, you may enter only once. You may also enter the Sweepstakes via the Mail-In entry method described in Section 4(B) below.

B. Via Mail-In: If you are not a user of the Wonolo App and you wish to enter for free, or you wish to enter the Sweepstakes without using the Wonolo App entry method, and you are otherwise eligible for the Sweepstakes, you may send an approximately 3″X5″ postcard to: Wonolo Inc., 9450 SW Gemini Dr. PMB 96809, Beaverton, Oregon 97008-7105. Include on your postcard the phrase “Wonolo Sweepstakes”, along with your First Name, Last Name, valid email address associated with your Wonolo account, mailing address, mobile phone number or home phone number, and any other information specified in the Promotional Ad. Each stamped postcard is equivalent to one entry. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of Wonolo.

5. Prizes

The prizes are as specified in the Promotional Ad. All prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by winners is permitted where the prizes are not in cash. Acceptance of prize constitutes permission for Wonolo to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.

6. Odds

The odds of winning depend on the number of eligible entries received.

7. Winner Selection and Notification

The winner of the Sweepstakes will be selected in a random drawing under the supervision of Wonolo. The winner will be notified via email to the email address associated with the account of the Wonoloer within ten (10) days following the winner selection. Wonolo shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within 15 days from the time award notification was sent, or fails to timely return a completed and executed declaration and releases as required, the prize may be forfeited and an alternate winner selected. 

The receipt by winner of the prize offered in the Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE RULES BY A WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.

8. Terms

Wonolo reserves the right, in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Wonolo may select the winners from all eligible entries received prior to and/or after (if appropriate) the action taken by Wonolo. Wonolo reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the Sweepstakes or website or violates these Rules or the Services Agreement. 

Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Wonolo reserves the right to seek damages from any such person to the fullest extent permitted by law.

9. Limitation of Liability

By entering into the Sweepstakes you agree to release and hold harmless Wonolo and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) your participation in the Sweepstakes and/or your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Sweepstakes; (v) electronic or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (vi) the cost of any tax liabilities incurred by Wonolo as a result of your failure to pay all applicable taxes in a timely manner.

10. Final and Binding Decision

Wonolo has the right, in its sole discretion, to maintain the integrity of the Sweepstakes, to void entries for any reason, including, but not limited to cheating, deception, fraudulent conduct or use of fraudulent methods or other actions, including attempting to circumvent the Standard Terms or these Rules. In case of any disputes, our decision shall be final and binding upon the parties.

11. Governing Law and Jurisdiction

THIS SWEEPSTAKES IS GOVERNED BY THE LAWS OF U.S.A. AND CALIFORNIA, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Sweepstakes, you agree that any and all disputes which cannot be resolved between you and Wonolo arising out of this Sweepstakes, shall be resolved individually, without resort to any form of class action, exclusively before a court located in California having jurisdiction. Further, in any such dispute, under no circumstances will you be permitted to obtain awards for, and you hereby waive all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than your actual out-of-pocket expenses (i.e. costs associated with entering this Sweepstakes), and you further waive all rights to have damages multiplied or increased. This provision does not supersede, modify, limit, or otherwise abrogate any agreement you may have to arbitrate disputes with Wonolo as set forth in the Services Agreement or otherwise.

12. Privacy Policy

13. Winners List

To obtain a copy of the winner’s name or a copy of these Rules, mail your request along with a stamped, self-addressed envelope to: Wonolo Inc. Attn: Sweepstakes, 9450 SW Gemini Dr. PMB 96809, Beaverton, OR 97008-7105. Requests must be received no later than six (6) months after the termination of the applicable Sweepstakes Period.
